Terms of Service

1. Acceptance of these terms
These Terms of Service (“Terms”) govern your access to and use of FeedSplit, operated by Martin Aberastegue as a sole proprietor in Germany (“FeedSplit”, “we”, “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
2. The service
FeedSplit ingests product feeds from URLs or direct uploads, transforms them via configurable rules and templates, and outputs them as either hosted XML feeds (which you submit to Google Merchant Center) or as a direct push to Google Merchant Center via the Merchant API, on your behalf and using credentials you have explicitly authorized.
3. Your account
- You must provide accurate information at sign-up.
- You're responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- One human per account. Sharing credentials across multiple people, or creating multiple accounts to bypass plan limits, is a breach of these Terms.
- The service is intended for business use. You must be at least 18 years old or the age of majority in your jurisdiction.
4. Subscriptions and billing
Plans and current prices are published on https://app.feedsplit.com/settings/billing (in-app) and may also be referenced on the marketing site. Payment is processed by Stripe; we never see or store your card number.
- Subscriptions renew automatically (monthly or annually, depending on plan) until cancelled.
- Cancellation takes effect at the end of your current paid period. You keep access until then.
- We do not offer pro-rated refunds for partial-period cancellations except as described in §5.
- We may change prices for future billing periods with at least 30 days' notice via email.
5. 30-day money-back guarantee
We offer a full refund on your first paid charge if you request it within 30 days of that charge, no questions asked. Email privacy@feedsplit.com (or hi@feedsplit.com) with your account email and we'll process the refund within 10 business days. The guarantee covers only your first paid charge. Subsequent renewals are non-refundable, though you can cancel at any time to stop future billing.
6. Acceptable use
You agree not to:
- Use the service to process illegal content, prohibited products, or anything that violates Google Merchant Center policies or other destination-platform policies.
- Attempt to break, overload, denial-of-service, reverse-engineer, or otherwise interfere with the service or its infrastructure.
- Scrape or copy substantial portions of the marketing site or in-app interface.
- Resell, sub-license, or share your account credentials.
- Push product feeds for businesses you don't represent or aren't authorized to act on behalf of.
- Use the service in any way that exposes us to legal liability or violates applicable law.
We reserve the right to suspend or terminate accounts that violate this section, with or without notice depending on severity.
7. Your content
You retain ownership of the product feeds, rules, configurations, and any other content you create or upload (your “Content”). You grant FeedSplit a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your Content solely for the purpose of providing the service to you, including pushing it to destinations you've authorized (such as Google Merchant Center).
You represent that you have the right to upload your Content and that doing so does not violate any third-party rights.
8. Third-party services
FeedSplit integrates with third-party services (Google Merchant Center, Stripe, others). Your use of those services is also subject to their own terms:
We're not responsible for actions taken by these third parties, including account suspensions, product disapprovals, API downtime, or pricing/policy changes on their side.
9. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Cloudflare, Google, Stripe, Resend, etc.), and rare unscheduled incidents can affect availability. Formal Service Level Agreements (SLAs) are offered only on plans that explicitly include them.
10. Termination
You can cancel your subscription at any time from your billing page. Access continues until the end of the period you've paid for.
We may suspend or terminate your account for material breach of these Terms, non-payment, or extended inactivity, with reasonable notice where practical. On termination, we stop billing and your access ends; data retention follows the periods documented in the Privacy Policy.
11. Warranties and disclaimers
The service is provided “as is” and “as available” without warranties of any kind, express or implied, except those that cannot be legally excluded.
We do not warrant that the service will be uninterrupted, error-free, or secure, that feed pushes will always be accepted by Google Merchant Center, that products will be approved for serving, or that advertising performance will improve. Statutory consumer-protection rights (including under EU law) remain unaffected for users acting as consumers.
12. Limitation of liability
To the maximum extent permitted by applicable law, our total liability arising out of or relating to the service, the Terms, or any product offered by us is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, advertising-spend losses, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited by law (including gross negligence, willful misconduct, fraud, or death/personal injury caused by our negligence).
13. Indemnification
You agree to indemnify and hold harmless FeedSplit and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your Content; (b) your misuse of the service; (c) your breach of these Terms; or (d) your violation of any third-party right or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of Germany, without regard to its conflict-of-law principles. Any dispute will be resolved before the courts of the operator's residence, except where applicable law requires that consumer disputes be heard in the consumer's home jurisdiction (in which case those rules apply).
15. Changes to these Terms
We may revise these Terms from time to time. Material changes will be communicated to active account holders by email at least 30 days before they take effect, and the “Last updated” date will change. Continued use of the service after the effective date constitutes acceptance.
